Eat Street Northshore – Vendors Terms and Conditions
General Terms and Conditions
By submitting an application for Eat Street Northshore, the Vendor acknowledges that they have read and understood and agree to comply with the Terms and Conditions, the Privacy Policy and the exclusion of liability and indemnity which are available at www.eatstreetnorthshore.
In this document, “we”, “us” and “our” means Goodwill Projects Pty Ltd ACN 133 432 078 and Northshore Street Food and Art Markets Pty Ltd ACN 165 800 706. “You” means the vendor and any of your employees, agents, contractors and invitees.

Food Stall License
If you are operating a Food Business and are unsure about Brisbane City Council requirements for a “Food Business License” please contact the Brisbane City Council on 133 263 or visit the Council’s website at www.brisbane.qld.gov.au for further information.
As a general guide, any cafe, restaurant, takeaway or similar food business in a fixed location that prepares or handles unpackaged food for retail sale needs a licence.
All Licensees that are required to hold a Food Business Licence must also disclose their Eat Safe Food Safety Rating. Minimum Eat Safe Food Safety Rating is five (5) stars. This should reflect the highest minimum standard of cleanliness at all times during and after trading.
Insurance
All vendors must, in connection with the Licensed Premises, take out and maintain for the duration of the Term, with insurers of at least A- Standard and Poor’s rating:
- public and product liability insurance for at least $20,000,000.00
- comprehensive motor vehicle liability insurance covering legal liability to third parties for property damage arising from the use of any motor vehicle, plant and equipment used by you (whether registered or unregistered) on or about the Venue for an amount not less than $20,000,000.00.
- business property insurance covering accidental loss or damage to all items of both your property and our property in the Licenced Premises for their full reinstatement or replacement value against the usual perils of fire, lightning, explosion, storm and tempest.

Restrictions
Products for sale are limited to:
- Food & associated products
- Plants & flowers
- Fashion & lifestyle products
The sale of some second hand items and counterfeit/illegal goods is not allowed.
Eat Street Northshore reserves the right to refuse entry, remove attendance or restrict trade at the venue at any time.
Rubbish
You must keep the Licensed Premises (including everything in it) and immediate surroundings clean and tidy and free of rubbish at all times. The Licensed Premise must be cleaned at the end of each Trading Day.
Damages
You must at your cost keep and maintain the Licenced Premises (and for the avoidance of doubt including where installed air conditioning units) and any of Eat Street Northshore’s Property and your property on and/or used in the conduct of your business from the Licensed Premises, in a good and safe condition and repair, including rectifying any damage and carrying out any repairs, maintenance or replacement of any part of your property caused or contributed to by:
- fair wear and tear; and
- circumstances beyond your control; and
- any damage deliberately caused by, or resulting from negligence of, you or any of your employees, agents, suppliers, contractors, sub-contractors o
r representatives.
Power
Vendors are not, under any circumstances, to approach or touch any power outlets around the venue any time. If there are any issues with the power, staff is to be contacted via the Venue mobile (0428 485 242) immediately.
All leads must be of commercial grade, minimum of 25 metres in length and tested and tagged.
Exclusion of Liability
To the maximum extent permitted by law, we exclude and are released from any liability to you and your employees, agents, contractors and invitees, whether in contract, tort, statute or any other way, for any personal or financial injury, damage or loss of any kind whatsoever (including, without limitation, any liability for direct, indirect, special or consequential loss or damage), sustained by you, your employees, agents, contractors, invitees and/or any other person, or for any costs, charges or expenses incurred by you, arising from or in connection with your occupancy of the Licensed Premises, unless caused by (and only to the extent of) our wilful misconduct, negligence or breach of a statutory duty or warranty.
Indemnity
You are liable for and indemnify us and our directors and officers from and against any claim or action (whether in contract, tort, statute or otherwise, including for negligence), liability, loss, damage, costs (including but not limited to, legal costs on a full indemnity basis), charges and expenses arising from or in connection with your occupancy of the Stall, including, without limitation, loss of or damage to property, or personal injury or death of any person.
This indemnity is independent from your other obligations under these Terms and Conditions and will continue while you are a Vendor and after you have ceased to be a Vendor. We may enforce this indemnity before incurring expense.
